1. Introduction

This User Agreement and Privacy Policy ("Agreement") is a legally binding contract between Ejaz Information Technology Solutions, a limited liability company registered in Riyadh, Kingdom of Saudi Arabia, and the user ("you") of the Nua application.

By creating an account or using the application, you agree to all terms and conditions contained in this Agreement. If you do not agree to these terms, you must stop using the application and delete your account.

2. User Eligibility and Registration Requirements

  • You must be 18 years of age or older.
  • You must have legal capacity to enter binding contracts in your country.
  • You must provide accurate and complete registration information.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • Creating more than one account per person is prohibited.

3. Services Provided

Nua is a digital health and wellness platform designed to provide analysis of physiological and activity data.

  • Heart Rate: Monitoring during rest and activity.
  • Blood Oxygen (SpO₂): Tracking oxygen saturation levels.
  • Sleep Patterns: Analysis of sleep quality and duration.
  • Steps and Calories: Tracking movement and energy expenditure.
  • Workouts: Recording various physical activities.
  • Recovery: Reports on the body’s recovery after exertion.

The Company reserves the right to modify, update, or discontinue any part of the services at any time without prior notice.

4. Subscriptions and Payments

Subscription Models

The application offers paid subscription plans that provide access to full features.

Billing and Auto-Renewal

Subscriptions renew automatically unless cancelled at least 24 hours before the renewal date. Subscription prices are subject to 15% VAT in Saudi Arabia.

Refund Policy

Refunds are not provided for partially used subscription periods. In the case of a verified technical issue, a refund request may be submitted within 7 days of the subscription date.

Trial Period

A free trial may be offered. At the end of the trial, the paid subscription will activate automatically unless cancelled.

5. Integration with Health Devices and Platforms

Nua may integrate with the following platforms:

  • Apple Health
  • Google Fit
  • Samsung Health
  • Garmin
  • Fitbit
  • Whoop
  • Huawei Health Kit

Data Access

Health data will only be accessed after receiving explicit user consent through the platform authorization process.

Data Minimization

Only the minimum amount of data necessary for application functionality will be requested.

Integration Management

Users may disconnect any platform integration through the application settings.

6. Medical Disclaimer

  • Nua is intended for health tracking and information management.
  • It does not provide medical advice or professional diagnosis.
  • Consult a physician before starting any diet or exercise program.
  • The application is not intended for emergency medical situations.

7. Intellectual Property Rights

The application and all related content are the property of Ejaz Information Technology Solutions and are protected under Saudi intellectual property laws.

Users are granted a limited license for personal, non-commercial use only.

8. User Content and Acceptable Conduct

Users are responsible for the content they upload such as meal photos, personal images, and notes.

Posting illegal, fraudulent, or rights-violating content is strictly prohibited.

9. Privacy and Data Security

  • We collect personal, health, and device usage data.
  • Data is encrypted using approved security protocols.
  • We comply with the Saudi Personal Data Protection Law (PDPL).
  • Health data is not sold to third parties.

Data may be shared with essential service providers such as SMS verification providers under strict confidentiality agreements.

10. Your Rights as a User

Under the Saudi Personal Data Protection Law (PDPL), users have the right to:

  • Access their personal data
  • Correct inaccurate information
  • Delete personal data
  • Transfer their data
  • Withdraw consent at any time

11. Limitation of Liability

To the maximum extent permitted by Saudi law, the Company is not liable for indirect damages resulting from the use of the application.

Maximum liability shall not exceed the subscription fees paid during the three months preceding the incident.

12. Termination of Account and Service

Users may terminate their account at any time.

The Company reserves the right to suspend or terminate accounts that violate the terms or provide false information.

13. Amendment of the Agreement

The Company may update this Agreement. Users will be notified of significant changes via email or in-app notification.

14. Governing Law and Dispute Resolution

This Agreement is governed by the laws of the Kingdom of Saudi Arabia. Any disputes will fall under the jurisdiction of the courts in Riyadh.
